The Litigation Process: What to Expect

Every case is unique, but the legal process follows a standard procedure. Whether you’re pursuing a claim or defending against one, here’s what you can expect:

Step 1: Pre-Litigation

Before filing a lawsuit, your attorney will research your case, gather evidence, and prepare or respond to a demand letter. If a resolution isn’t reached, a complaint is filed in court, officially starting the lawsuit.

Step 2: Discovery & Fact-Finding

Once a lawsuit is filed and responded to, both sides enter discovery—the exchange of documents, records, and other evidence. This is often the most detailed and time-consuming phase of litigation.

Step 3: Summary Judgment

If there are no disputed facts after discovery, either party may ask the court to rule on the case without a trial. If granted, the case is resolved without going to court.

Step 4: Trial

If key facts remain in dispute, the case goes to trial, where both sides present evidence, and a judge or jury determines the outcome.
